Local Eviction Moratoria


Last month the Oregon legislature voted to extend the state’s eviction moratorium through the end of June 2021. This means that if tenants cannot pay their rent landlords cannot evict them until at least July. But these tenant protections are not automatic. In order to be protected from eviction tenants must submit an official Hardship Declaration to their landlord. If the tenant receives an eviction notice for non-payment of rent before submitting a hardship declaration, they can still submit the declaration and be protected from eviction. The Hardship Declaration states that the tenant has suffered economic hardship due to the ongoing COVID-19 pandemic that prevents them from paying rent. The declaration also requires tenants to acknowledge that all back rent is due in full by July 1, 2021.

Lawmakers also allocated $150 million to a Landlord Compensation Fund to help landlords that cannot collect rent. Landlords must have received a Hardship Declaration from their tenant in order to access these funds and they must also agree to forgive 20% of the back rent owed by their tenant(s). In addition to the $150 million allocated to landlord compensation, the state legislature also allotted $50 million in rental assistance for tenants.

Multnomah County

Multnomah County also has an eviction moratorium and the board of county commissioners voted last month to extend it until July 2, 2021. Unlike the state-wide rules, tenants living in Multnomah County will have six additional months to pay back rent. They have until the end of 2021 before landlords can take action due to nonpayment of rent.

Washington State

Washington State also has an eviction moratorium in place that was recently extended through March 2021. It bans evictions and late fees on unpaid rent and also requires landlords to offer a repayment plan for unpaid rent.
